U.S. Court of Appeals upholds Zyprexa patent against generic challenge
Published by Gavin Baker December 27th, 2006 in News, Intellectual PropertyOn 26 December, the U.S. Court of Appeals for the Federal Circuit upheld the patent on Eli Lilly’s Zyprexa, the antipsychotic drug olanzapine. The appellate court affirmed the ruling of the lower court, against the claims of three generic manufacturers.

The generic companies contended the Zyprexa patent was invalid because it was too similar to a previous patent held by Lilly, and that a form of the drug was in public use before Lilly received its patents.
